Who these terms apply to
These terms apply to anyone who engages MardenDigital (Marden Evans, trading as MardenDigital, based in Wales, UK) for website design, website maintenance, SEO, or social media management services. By paying a deposit, signing a proposal, or asking us to start work, you’re agreeing to these terms.
Services covered
Website design and build (new sites and redesigns). Website maintenance / care plans (updates, backups, security monitoring, small fixes). SEO (on-page optimisation, content, technical fixes, local SEO/Google Business Profile). Social media management (content creation, posting, reels, captions).
Exact scope for your project is set out in your quote or proposal. These terms cover the general rules; the proposal covers what’s actually being delivered.
Getting started
For website work, a deposit is required before any work begins, no exceptions. Once the deposit lands, your project slot is confirmed and work starts. For ongoing retainers (SEO, social, maintenance), work begins from the agreed start date once the first invoice is paid.
Payment – one-off website builds
Deposit of £50 is required upfront, before any work begins. This secures your project slot and covers discovery and design. No work starts without it. Remaining 50% is due before the site goes live.
This deposit requirement applies to every website project regardless of size. The percentage split can be adjusted in your proposal if agreed in writing, but the “deposit before work starts” rule itself doesn’t move.
Payment by bank transfer (BACS) unless otherwise agreed. Invoices are due within 14 days unless the proposal says otherwise. Domain registration and any premium themes, plugins, or stock assets are billed separately at cost, always agreed with you before purchase.
Payment – monthly retainers (SEO, social media, maintenance/care plans)
Billed monthly in advance, due on the date agreed at the start of the retainer. Rolling month to month, no fixed contract length unless otherwise agreed. Either side can cancel with 30 days’ written notice (email is fine). Late payment may result in work being paused until the account is up to date.
Revisions and changes
Small revisions during a build (copy tweaks, colour/image swaps) are included as part of the normal back-and-forth. Bigger changes, new pages, extra features, a different platform, or expanded scope, are quoted separately before any extra work starts, so there’s never a surprise bill. For ad-hoc fixes outside a maintenance plan: small fix (under 1 hour) from £50, medium fix (1-3 hours) from £100, bigger issues quoted before starting.
Ownership
Once the final invoice for a website build is paid in full, you own the content, branding, and completed site for your business’s use. If MardenDigital manages your hosting or domain on your behalf as part of a retainer, this remains accessible to you and can be handed over if you leave, you’re never locked out of your own site or domain. MardenDigital may display completed projects in its own portfolio, case studies, and marketing (screenshots, results, general description of the work) unless you ask us not to. We’ll never share confidential business information, customer data, or anything commercially sensitive. Third-party licences (premium themes, plugins, stock photos) remain subject to their own provider’s terms.
What we need from you
Timely delivery depends on getting from you, when asked: content (text, images), feedback within a reasonable time, and any account access needed (hosting, domain, Google Business Profile, social accounts). Delays on your end may push back the agreed timeline, we’ll flag this if it happens rather than let it slide silently.
No guaranteed results
We work to genuinely improve your website, rankings, and social presence, and we’re honest about what’s realistic. But SEO rankings, social media growth, and enquiry volume depend on factors outside our control (search engine algorithms, competitors, platform changes, market conditions). We don’t guarantee specific rankings, follower counts, or enquiry numbers, we do guarantee the work itself is done properly and reported on honestly.
Liability
Our liability for any claim relating to the work is limited to the amount you’ve paid us for that specific project or the most recent 3 months of a retainer, whichever applies. We’re not liable for indirect losses, third-party service outages (hosting, domain registrars, social platforms), or issues arising from changes you or someone else makes to the site/accounts after handover.
Cancellation
Website builds: if you cancel after work has started, you’ll be invoiced for work completed to that point at a fair hourly rate. The deposit is non-refundable once discovery/design work has begun, as it covers time already committed. Retainers: 30 days’ written notice, as above, no cancellation fee.
Confidentiality
Anything you share with us about your business that isn’t already public is kept confidential and only used to deliver your project.
Governing law
These terms are governed by the law of England and Wales.
Changes to these terms
If these terms change, the “Last updated” date above will change, and existing clients will be given reasonable notice before anything materially different applies to ongoing work.
